Mr President, it takes courage, commitment is needed to say no to the praise of men and, at the same time, to do what the American people are doing properly. You have that courage, and the American people can take solace because you have your back. There are also serious legal and constitutional issues. Foreign leaders in Europe, Asia and around the world should have no more to say about the U.S. economy than our own citizens and their elected representatives. That is why our withdrawal from the agreement is a reaffirmation of American sovereignty. (Applause) Our constitution is unique among all the nations of the world, and it is my supreme commitment and the greatest honor to protect them. And I will. In addition, the agreement establishes a new mechanism to “facilitate the implementation and promotion of respect.” This “non-contradictory” expert panel will try to help countries that are lagging behind their commitments get back on track. There is no penalty for non-compliance.
How humiliated is America? How much do they make fun of us as a country? We want fair treatment of citizens and we want fair treatment of our taxpayers. We do not want other leaders and other countries to make fun of us. And they won`t be. You won`t be. As explained in this C2ES edition letter, the participation of the United States in the Paris Agreement can only be decided by the President, without, among other things, seeking the Council and the approval of the Senate, because of the establishment of an existing treaty, the United Nations Convention on Climate Change. If Biden is president, he would have enough authority to join it as an “executive convention.” Yes, yes. The agreement is considered a “treaty” in international law, but only certain provisions are legally binding. The question of what provisions should be made mandatory was a central concern of many countries, particularly the United States, which wanted an agreement that the President could accept without the approval of Congress. The completion of this test excluded binding emissions targets and new binding financial commitments. However, the agreement contains binding procedural obligations, such as the requirements for the maintenance of successive NPNSPs and consideration of progress in their implementation. While mitigation and adjustment require more climate funding, adjustment has generally received less support and has mobilized fewer private sector actions.  A 2014 OECD report showed that in 2014, only 16% of the world`s financial resources were devoted to adaptation to climate change.
 The Paris Agreement called for a balance between climate finance between adaptation and mitigation, highlighting in particular the need to strengthen support for adaptation from the parties most affected by climate change, including least developed countries and small island developing states. The agreement also reminds the parties of the importance of public subsidies, as adjustment measures receive less public sector investment.  John Kerry, as Secretary of State, announced that the United States would double its grant-based adjustment funding by 2020.  Under the Paris Agreement, each country must define, plan and report regularly on its contribution to warming mitigation.  There is no mechanism for a country to set an emission target for a specified date, but any target should go beyond the previous targets. The United States formally withdrew from the agreement the day after the 2020 presidential election, although President-elect Joe Biden said America would return to the agreement after his inauguration.  The Paris Agreement provides for a number of binding procedural obligations.
